HOW TO PARTICIPATE AND CLAIM COLLECT AND REDEEM ITEMS

To redeem CODES, scan QR code appearing on pack or POS. You will be redirected to complete your account set up (your cell number, name, address, date of birth, and email address). Enter your CODE(s). Each CODE will automatically give you one (1) entry in the Sweepstakes (see Section 2). You will be provided options to redeem for a Collect and Redeem item or accumulate CODES for higher tier items. You may come back multiple times to enter CODES, your cell number is the account number. Once you have collected enough CODES to redeem for a desired item, select the item, and you will be directed to complete the claim form. The deadline to enter CODES is the promotion period end of August 31, and last date to claim items is October 31, 2022.

Regular text messaging rates, airtime, data, and carrier charges may apply, OR scan the QR code printed on point-of-sale materials found in stores. Only one (1) mobile phone number may be used by any one person to participate in this Promotion. Any personal information submitted will be used for the purposes of administering this Promotion only.

Please allow approximately four (4) weeks for delivery on gift card and subscription items or for further communication on festival, concert tickets or experience-based items after your order is placed. Collect and Redeem experiences will be fulfilled in 2023, except the Miami experience which may be fulfilled near the end of 2022 unless circumstances beyond the Sponsor’s control arise.

Bonus CODES and Bonus Sweepstake Entries – 5 bonus CODES and 5 bonus sweepstake entries will be allocated in the following circumstances: (a) upon signing up to receive a notification when the program launches from May 1, 2022, at 12:01 am ET to May 31, 2022, at 11:59 pm ET. Scan the QR code found on participating cans to access the portal to sign up. Fill in your Full Name, Phone Number, and check the notifications box to participate; (b) for returning customers upon registration in the program between June 1, 2022, at 12:01 am ET and August 31, 2022, at 11:59 pm ET. Use the QR code found on participating cans to access the portal to register in the program. Click on the register button and enter your First Name, Last Name, Email Address, Phone Number, Date of Birth and Postal Code. For this program, “returning customers” are users who participated in the 2021 Monster Energy Live Nation program.

Limit to one set of Bonus CODES and Bonus Sweepstake Entries per user.

You can also earn 5 bonus CODES and bonus sweepstake entries when you refer an individual with whom you have a family or personal relationship to the program, provided that individual then registers in the program. For these purposes a “family relationship” means the relationship between you and the individual to whom you are sending the message is sent if you and the individual to whom you are sending the message are related to one another through a marriage, common-law partnership or any legal parent-child relationship and those individuals have had direct, voluntary, two-way communication; and

A “personal relationship” means a relationship between the sender and the referred individual, where those individuals have had direct, voluntary, two-way communication and it would be reasonable to conclude that they have a personal relationship. The GIC Regulations set out a non-exhaustive list of factors that should be used to determine whether there is a personal relationship (e.g. the sharing of interests, experiences, opinions and information evidenced in the communications; the frequency of the communication, etc.).

Upon registration, the referred individual will earn five (5) bonus CODES and five (5) bonus sweepstake entries. To obtain this bonus, share the unique referral URL found within "my profile" by logging into the program. The referral URL can be shared with individuals with whom you have a family or personal relationship you think would be interested in learning about this program and would not consider this to be spam. When your friend clicks on the unique URL and registers to the program, you will each receive five (5) bonus CODES and five (5) bonus sweepstake entries. If you share this unique URL through social channels, please ensure that you are compliant with all applicable Terms of Use. Any share of this unique URL through social channels must include #contest/sweepstakes as part of your post.

The The Live Nation® Concert Cash® promotional code (“CC Code”) is issued by Live Nation and is subject to the following terms and conditions (“Terms”). The terms “you” or “your” mean the person to whom a CC Code was issued or given. Your receipt and/or redemption of a CC Code constitutes acceptance of and agreement with these Terms. Other terms and conditions may apply to tickets, venues, and the Ticketmasterwebsite. Specifically, without limitation, access to and use of products offered through the CC Code are subject to acceptance of the Ticketmasterwebsite Terms of Use found here. CC Codes are redeemable only on the website located at www.ticketmaster.ca/summermusic. Each CC Code is a one-time use only promo code good toward $5, $10, $25, $50 or $100 off (based on increment awarded) final ticket purchase for a select Live Nation produced and promoted concert in Canada ticketed on ticketmaster.ca, based on availability under this program. If a CC Code is used in violation of these Terms, Live Nation reserves the right to (a) cancel any ticket order, or (b) charge user’s credit card for value of tickets after shipment. Once tickets are issued, they cannot be exchanged for other tickets or merchandise.

*For all ticket items:
Tickets are subject to program availability, venue capacity, age, and artist restrictions. Tickets to a particular concert or festival (as applicable) are not guaranteed. Selection of ticket type and/or concert seat location (if applicable) is solely within Live Nation’s discretion. Parking, travel, and accommodations are not included and are the sole responsibility of the claimant and guest. Claimant and guest must abide by all concert/festival and venue policies. Live Nation reserves the right to revoke full or partial ticket related item from any claimant and guest who it and/or venue personnel deem may, in their sole discretion, be intoxicated, be a safety risk, have violated any concert/festival or venue policy or law, and/or may bring Live Nation Canada or Sponsor into disrepute. Claimant must select concert or festival (as applicable) at least thirty (30) days in advance of the concert/festival date or forfeits the item. No refund or compensation will be made in the event of the cancellation or delay. By claiming tickets, you agree to Live Nation’s Terms of use and to abide by the health and safety measures in effect at the time of your event, which may include, but not be limited to, wearing masks, providing proof of vaccination status and/or providing proof of negative COVID-19 status. Should the event be cancelled, you will be notified as soon as reasonably possible. Resale tickets is prohibited.

For concert tickets item:
A list of participating Live Nation produced and promoted concerts will be provided for the claimant to select one (1) concert. Claimant must select the concert prior to October 31, 2022.

For festival tickets items:
A list of participating Live Nation produced and promoted festivals will be provided for the claimant to select one (1) festival. Claimant must select the festival prior to October 31, 2022.

For festival tickets items:
^*1 “General Admission Festival Experience” includes two (2) GA tickets to one (1) festival as described above; and spending money of $1000.00 CAD will be awarded by the Sponsor. The ARV of each General Admission Festival Experience item is: $1,600.00 CAD.

^*2 “VIP Festival Experience” is a trip for two (2) to attend a participating festival in Canada of claimant’s choice as described above. Trip to be completed no later than December 31, 2023, or as determined by the Sponsor. The trip includes: (a) round-trip, economy class airfare tickets for the claimant and their one (1) guest from a major airport near the claimant’s residence in Canada (as selected by Sponsor in its sole discretion) to a Canadian city; (b) four (4) nights’ standard hotel accommodations (based on double occupancy); (c) two (2) VIP tickets (see Live Nation terms in Rule 10 under Appendix B); and (d) one thousand Canadian dollars in spending money ($1000.00 CAD). The approximate retail value (“ARV”) of each VIP Festival Experience is: $3,500 CAD maximum. The ARV of the trip may vary depending on the claimant's residence, market conditions, changes in value of components (e.g., air transportation and hotel rates) and other reasons. Sponsor is not responsible for, and the claimant will not receive, the difference between the actual value of the trip at the time of award and the stated ARV in these Official Rules or in any promotion-related correspondence or materials. Specific travel arrangements and all trip details not specified herein will be made and determined in Sponsor’s sole discretion. Travel must originate from and end at the same airport. It is the claimant’s and guest’s sole responsibility to comply with all travel requirements, which may include, without limitation, presenting necessary identification (including passport) at the time of travel. Flight schedules are subject to change without notice. Sponsor is not liable for any missed trip events, opportunities or expenses incurred as a consequence of flight cancellation/delay or ground transportation delay. Should the trip claimant live within 400km of their chosen city, they will be given $500.00 CAD in lieu of flights, to assist in covering their own ground transportation. Claimant will be required to provide a credit card at time of accommodation check-in to cover incidentals. Claimant’s guest must be age of majority in their province or territory of residence or older at time of item redemption Sweepstakes draw. Any claimant that is only eighteen (18) travelling to a province/territory that has an age of majority of nineteen (19) must choose a guest who is at least 19 years of age.

^*3 “VIP Miami Experience” is a trip for two to Miami, Florida to attend the Coi LeRay performance. The trip includes: (a) round-trip, economy class airfare tickets for the VIP Miami Experience claimant and their one (1) guest from a major airport near the claimant’s residence in Canada (as selected by Sponsor in its sole discretion) to Miami, Florida; (b) three (3) nights’ standard hotel accommodations (based on double occupancy); (c) two (2) VIP tickets to Coi LeRay performance in Miami, FL scheduled to take place on December 2, 2022; and (d) one thousand Canadian dollars in spending money ($1000.00 CAD). The approximate retail value (“ARV”) of the VIP Miami Experience is: $3,500 CAD maximum. The ARV of the VIP Miami Experience may vary depending on the claimant’s residence, market conditions, changes in value of components (e.g., air transportation and hotel rates) and other reasons. Sponsor is not responsible for, and the claimant will not receive, the difference between the actual value of the trip at the time of award and the stated ARV in these Official Rules or in any promotion-related correspondence or materials. Specific travel arrangements and all trip details not specified herein will be made and determined in Sponsor’s sole discretion. Travel must originate from and end at the same airport. It is the claimant’s and guest’s sole responsibility to comply with all travel requirements, which may include, without limitation, presenting necessary identification (including passport) at the time of travel. As the event venue has an age restriction and is only open to people who are at least 21, they will be awarded the item value of $3500.00 CAD in lieu of the trip, or the VIP Festival Experience (ARV $3500 CAD).

Collect and Redeem experiences will be fulfilled in 2023, except the Miami experience which may be fulfilled near the end of 2022 unless circumstances beyond the Sponsor’s control arise.

The approximate retail values set out above are based on approximate values in Canada at the time of printing these Official Rules. All characteristics and features of the items, except as otherwise explicitly outlined above, will be determined by Sponsor in its sole and absolute discretion. Collect and Redeem items are while supplies last.

Collect and Redeem item suppliers are independent parties over which Sponsor does not exercise any control. Sponsor is not responsible for the acts or omissions of these suppliers nor does it assume responsibility for any warranty, claims, losses, damages, costs, expenses, delays or loss of enjoyment to any participant.

Each item must be accepted as awarded, and may not be assigned, substituted or redeemed for cash value. In case of the unavailability of any Collect and Redeem item, Sponsor reserves the right to substitute an item of equal or greater value.

All claimed CODEs become the property of the Sponsor and will not be returned.

GENERAL RULES

By entering the Sweepstakes, the Grand Prize winners agree to sign a waiver, as described above. In addition, Grand Prize winners agree to the use of their name, place of residence and image in any publicity carried out by Sponsor without compensation.

By accepting any prize in connection with this Sweepstakes, winners agree to release, remise and forever discharge Sponsor, Promotion Entities, Live Nation, participating prize providers, promotional agencies, franchisees, retailers, distributors, advertising and promotion agencies, webmasters and any company involved in the creation, design, execution, production, or fulfillment of this Promotion, and each of their respective parent companies, affiliates, subsidiaries, successors, assigns, agents, representatives, officers, directors, shareholders, and employees (collectively “Released Parties”), from and against any and all liability claims, costs, injuries, losses or damages of any kind incurred in connection with the delivery, installation, use and consumption of any Prize.

Sponsor assumes no responsibility or liability for lost, late, misdirected or incomplete entries, CODEs, codes and release documents or for any problems or failures. Sponsor is not responsible for any incorrect or inaccurate information, or by any technical or human error, which may occur in the processing of entries in the Sweepstakes, or in claiming of Collect and Redeem items. If, for any reason, the Promotion is not capable of running as planned, including tampering, unauthorized intervention, fraud, technical failures, coronavirus (COVID-19) pandemic, other epidemics or medical emergencies, or any other causes beyond the control of Sponsor that corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion or cause it to not comply with any applicable law having jurisdiction over Sponsor, then, subject to regulatory approval when required, Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend this Promotion without notice.

Sponsor reserves the right to disqualify any entrant who it finds to be in violation of these Official Rules or tampering with the Promotion process. Sponsor reserves the right to refuse an entry from a person whose eligibility is in question or who has been disqualified or is otherwise ineligible to participate. Any attempt by anyone to deliberately undermine the legitimate operation of this Promotion is in violation of criminal and civil laws and Sponsor reserves the right to seek damages or other legal remedy to the fullest extent permitted by law.

All decisions of Sponsor in connection with this Promotion are final and binding in all respects. Each Prize must be accepted as awarded. Each Prize is non-transferable.

All entries become the property of Monster Energy Canada Ltd. and will not be returned.

This Promotion and the terms and conditions contained in these Official Rules, shall be exclusively governed by and construed in accordance with the laws of the Province of Ontario, Canada and the federal laws of Canada applicable therein.

This promotion is subject to all applicable federal, provincial and municipal laws and is void where prohibited.

Quebec Residents only (regarding the Sweepstakes): Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux (the “Régie”) for a ruling. Any litigation respecting the awarding of the prize may be submitted to the Régie only for the purpose of helping parties reach a settlement.

For residents of all provinces, excepting Quebec: All disputes, disagreements, controversies, questions or claims arising out of or relating to this Promotion, including, without limitation, with respect to its execution, validity, application, interpretation, performance, breach, termination or enforcement (“Disputes”), shall be (a) resolved individually, without resort to any form of class action, and (b) shall be determined by a sole Arbitrator (the “Arbitrator”) under the Arbitration Act, 1991 (Ontario) (the “Act”). The resolution of Disputes pursuant to this section shall be final and binding upon the parties, and there shall be no appeal therefrom, including, without limitation, any appeal to a court on a question of law, a question of fact or a question of mixed fact and law. In addition: (a) section 7(2) of the Act will not apply to the arbitration; (b) unless the parties otherwise agree, the Arbitrator will be appointed by a judge of the Superior Court of Justice of Ontario on the application of any party on notice to all the other parties. No individual shall be appointed as Arbitrator unless they agree in writing to be bound by the provisions of this Article; (c) the arbitration shall take place in the City of Toronto unless otherwise agreed in writing by the parties; (d) subject to the Act, the Arbitrator may conduct the arbitration in the manner the Arbitrator considers appropriate; (e) the language to be used in the arbitration shall be English; (f) within seven (7) calendar days after appointment the arbitrator shall set the hearing date, which shall be within ninety (90) calendar days after the filing date of the demand for arbitration unless a later date is required for a good cause shown. The parties agree to a mutual exchange of relevant documents and the taking of up to a maximum of five (5) depositions by each party to last no more than two (2) calendar days in aggregate for each party; (g) the parties desire that any Dispute should be conducted in strict confidence and that there shall be no disclosure to any person of the existence of the Dispute or any aspect of the Dispute except as is necessary for the resolution of the Dispute; and (h) the Arbitrator shall have the right to determine all questions of law and jurisdiction, including questions as to whether a claim is arbitral, and shall have the right to grant legal and equitable relief including injunctive relief and the right to grant permanent and interim injunctive relief, and final and interim damages awards. The Arbitrator shall also have the discretion to award costs, including reasonable legal fees and expenses, reasonable expert's fees and expenses, reasonable witnesses' fees and expenses pre-award and post-award interest and costs of the arbitration.
